Terms of submission

1. TERMS

These terms and conditions (together with the documents referred to in it) explain the terms on which you may use the site to submit applications for access to research infrastructures at the Access Providers within the ASSEMBLE Plus consortium. Please read these terms carefully before submitting any content: by submitting an application you indicate that you accept these terms and you agree to abide by them. If you do not agree to these terms, you may not use the site to make submissions.

 

2. CHANGES TO THESE TERMS

We may revise these terms of use at any time. Please check the Transnational Access (TA) policy document at /projects/assembleplus/access/download-area from time to time to take notice of any changes we made, as they are binding on you.

 

3. SERVICE AVAILABILITY

ASSEMBLE Plus accepts applications for funded Transnational Access (TA) to Access Provider from persons employed in any country. However, access for a user – or a user group – whose home institution is situated outside the EU or an Associated Country is limited to 20% of the total amount of units of access provided under the Grant. 

 

4. APPLICATION SUBMISSION

  • In order to request access to facilities at the ASSEMBLE Plus Access Providers, you must register to a web-based application system and submit an application.
  • ASSEMBLE Plus procedures for appeal, the criteria for eligibility, evaluation and implementation of successful applications are explained at www.assembleplus.eu/access/transnational-access. Please contact assembleplus_ta@embrc.eu if you have further questions.
  • By submitting an application, you represent and warrant that you are employed by an accredited scientific organisation and that your application contains only information which is true, accurate and complete.
  • By submitting an application via the system, you grant to ASSEMBLE Plus a revocable and non-exclusive licence to reproduce, modify, prepare derivative works of and otherwise use and disclose the content for the purposes of evaluating the application and assessing the feasibility of conducting the proposed research at the requested facility.
  • ASSEMBLE Plus will use its reasonable endeavours to keep applications confidential and will only disclose applications to those third parties for whom it considers access reasonably necessary to perform the evaluation described at clause 4.2 or where required by law.
  • Applicants will be informed of the outcome by email. Successful User names and Access Providers will be displayed on the ASSEMBLE Plus website in the public domain, and may be shared with funding bodies on request.

 

5. ON-SITE ACCESS

  • User status does not convey any entitlement to statutory health, nursing care, accident, unemployment or pension cover. Full health-, travel- and personal accident insurance is obligatory. It must cover the full period from arrival to departure. It is strongly recommended that User(s) should arrange adequate insurance cover prior to traveling.
  • The Access Provider’s management reserves the right to cancel or reschedule visits.
  • When using Access Provider facilities, the User shall comply with their regulations, including health and safety requirements, presented to the researcher at arrival. The visiting researcher shall be subject to the authority of the Access Provider management.
  • The visiting researcher shall treat the Access Provider facilities with due care and protect these against loss or damage.
  • The institution hosting a User shall bear responsibility for ensuring the agreed work or service is delivered in accord with the regulatory and safe working practises required by the host institution, including ensuring appropriate permissions and training are in place before work commences. The Applicant must specify permit requirements in the application. If the application is approved, the TA may take place once the permits are granted, even if beyond the preferred time-window indicated in the call. ASSEMBLE Plus shall not be liable for any accidents or infringements arising from an on-site access.
  • Outcomes resulting from work carried out under the ASSEMBLE Plus TA activity must acknowledge the ASSEMBLE Plus project as follows: “The research leading to these results received funding [or partial funding] from the European Union’s Horizon 2020 research and innovation programme under grant agreement No 730984, ASSEMBLE Plus project”. The links of such publications must be sent to assembleplus_ta@embrc.eu to be stored in the ASSEMBLE Open Access Repository.
  • The User, following the end of the on-site access is required to submit a reimbursement claim and to provide all requested documents as specified in the provisions of the User Access Contract.

6. ALL SUBMISSIONS

  • Where you are required to complete a registration form in order to access restricted parts of the site or specific services, you agree to:
    • provide true, accurate, current and complete information; and
    • to maintain and promptly update your user profile to keep it true, accurate, up-to-date and complete.
  • If ASSEMBLE Plus has reasonable grounds to suspect that any information supplied is untrue, inaccurate, out-of-date or incomplete, it reserves the right to suspend or terminate your registration and any access you may have to restricted parts of the site or any and all services.
  • Other than the limited licence set out in clauses 5, 6 and 7 (as applicable), ASSEMBLE Plus acknowledges and agrees that it obtains no right, title or interest from you (or your licensors) under these terms of submission in or to any content that you submit, including any intellectual property rights which may subsist in that content (whether those rights are registered or not, and wherever in the world those rights may exist). You acknowledge and agree that you are responsible for protecting and enforcing those rights and that ASSEMBLE Plus has no obligation to do so on your behalf.
  • You acknowledge that:
    • you have received good and valuable consideration in exchange for the applicable licence and that you are not entitled to any further compensation for any use by ASSEMBLE Plus of the content in accordance with that licence; and
    • ASSEMBLE Plus may, without notice to you, reject, refuse to use or delete any content at any time where it considers this to be reasonably necessary.

 

7. DATA MANAGEMENT POLICIES

ASSEMBLE Plus has established Data Management policies for both its users and facilities. You can view the Data Management Plan at the webpage /projects/assembleplus/access/DMP.

It is required to make all datasets produced with ASSEMBLE Plus funding Open Access and all publications based on those data to be published in Open Access journals. This includes data and publications produced by the TA users. You can find most common opt-outs at the webpage /projects/assembleplus/access/DMP.

 

8. PRIVACY POLICY

Personal data relating to your proposal submission will be stored securely according to General Data Protection Regulation (GDPR) and will be used for the purposes of processing your application, peer review, communications and managing the services. Details of the name and Home Institution country for successful candidates will be published online at the ASSEMBLE Plus website. Full details are given here (Privacy policy).
